A recent Federal mandate regarding Form I-9 Employee Eligibility Verification, effective August 1, 2023, requires in-person verification of Form I-9 employee eligibility verification documents for every employee hired since 2020. During the 2020-2023 pandemic and shift to remote working, the government allowed temporary flexibility with remote digital verification to meet compliance standards. As of August 1, 2023, employers must now conduct physical documentation reviews or video live chats for these required documents of eligibility to work in the United States for all hires since March 20, 2020. The implications for employers, both large and small, are considerable, and the deadline for compliance is December 31, 2023.


For example, an employer hired Deborah in May of 2021, and she provided a copy of her passport via email as proof of work eligibility for Form I-9 eligibility documentation. Her employer must now physically inspect this passport and reconfirm its authenticity. In addition, as of August 1, 2023, a new, revised form has been issued and must be used. A requirement of the new form is employers must conduct a physical documentation review for all new hires.

The future of remote Form I-9 verification remains uncertain. ICE has proposed modifications that may allow permanent remote verification in the future but has yet to finalize them. In the meantime, failing to comply with these required regulations could lead to non-compliance and potential fines.
